Using ThoughtStream Lab
ThoughtStream Lab is both the app and the business behind it. It is owned and operated by SK America LLC, and it is SK America LLC that runs the app and holds the rights in its name and its contents.
In these terms, “we” and “us” mean SK America LLC, and the agreement you are accepting is with SK America LLC. By creating an account or using ThoughtStream Lab you agree to these terms. If you do not agree with them, please do not use the app. If you use ThoughtStream Lab for an organisation, you are confirming that you may accept these terms on its behalf.
Your account
- You must be 16 or older to hold an account.
- An account is for one person. Please do not share sign-in details so several people can use one allowance; that is what the fair use rules below are about.
- Keep your password to yourself, and tell us straight away if you think someone else has your account.
- You are responsible for what happens through your account.
Your words stay yours
Everything you write in ThoughtStream Lab belongs to you. We claim no ownership of it, and we do not use it for advertising or sell it to anyone.
To run the app we need your permission to store what you write, to send it to the AI service when you ask for an action, and to show it back to you and to any assistant you deliberately connect. That permission is only for operating ThoughtStream Lab for you, and it ends when you delete the content or your account.
You are responsible for what you capture and for having the right to upload anything you upload, including letterheads and signatures that may belong to someone else.
About the assistant
The assistant is a writing and reflection aid, and it can be wrong. It may misread a thought, suggest a connection that does not hold, or produce wording you would not use. It is not a lawyer, doctor, accountant or therapist, and nothing it produces is professional advice. Evidence states are yours to set: the app treats your judgement as the source of truth, not the assistant's.
Treat anything the assistant writes, including proofreads, drafts and letters, as a draft to check before you rely on it or send it to anyone.
Plans, prices and renewal
The tiers on sale, their prices and what each includes are set out on the plan page, and those are the terms that apply to your purchase.
- Monthly and yearly plans are subscriptions: they renew automatically, and they continue until you cancel them. The date yours renews is shown with your plan in the app.
- Before you pay, the payment page shows you what you are buying, the price, how often it is charged, and that it renews until you cancel. Your consent to that recurring charge is taken there, by you, and card details are handled by Base44 Payments. The app never sees or stores your full card number.
- You can cancel at any time, in one step, from the plan page in the app. No phone call, no email, no waiting for anyone, and no reason needed. It works online, in the same place you subscribed.
- When you cancel, you keep access until the end of the period you have already paid for, unless you ask for a refund instead (see below).
- A yearly plan gets a reminder before it renews, telling you the date and the amount.
- A lifetime plan is one payment. It does not renew, and there is nothing to cancel.
- Prices may change. We tell account holders by email before a change takes effect, we never apply a change to a period you have already paid for, and a price change never applies to you without that notice.
- If a change would materially reduce what your plan includes, we tell you by email before it takes effect, so you can decide what to do.
- If a charge looks wrong, or something went wrong with a purchase, write to billing@thoughtstreamlab.com and we will put it right.
Cancelling and refunds
You can have your money back. In the first 7 days you do not need a reason, and no law that gives you more takes second place to that.
- A full refund in the first 7 days, for any reason. If your last payment was taken within the last 7 days, ask for it back in full on the cancel screen or write to us, and you get the whole amount. You do not have to explain why.
- Whatever California requires, in full. Our 7 days is a promise on top of your rights, never a limit on them. Whenever California law entitles you to a charge back, we refund it in full, however long ago it was taken.
- That includes a renewal charged without the consent and the notice California's automatic renewal law requires. A charge made without those is money we were never entitled to: it comes back in full, and you owe nothing for that period.
- It includes a charge taken after you cancelled, a price increase applied without the notice that law requires, and a yearly renewal charged without the reminder that is due beforehand.
- Cancelling is one step, and it is always available. The cancel screen asks why you are going and may offer you extra time on your plan instead. Taking that offer is entirely your choice: declining it, or ignoring it, cancels just the same, and nobody has to speak to anyone or wait on a call.
- Gifts. A gift bought for someone else can be refunded in full to the buyer within 7 days of purchase while its code is unclaimed. Codes do not expire. If a code has already been claimed and you want to undo it, write to us and we will sort something out.
- How to ask. Use the cancel screen, or write to billing@thoughtstreamlab.com from the email address on your account with the date and the amount, and we will find the payment. If you are in California and think a charge was made without the consent the law requires, say so and we will deal with it on that basis.
- How it is paid. Refunds go back through Base44 Payments to the card or account you paid with, and we release them as soon as we can. How long the money then takes to show up is up to your bank or card issuer.
- Nothing here signs away a right. Nothing in these terms takes away a refund, a cancellation right, or any other protection the law gives you where you live, and we will never ask you to give one up.
Allowances and fair use
Each plan includes a monthly number of AI actions, and free accounts get a small monthly allowance. Exactly what counts as one action, and what happens when the month's allowance runs out, is set out on the usage and limits page, which forms part of these terms.
Using it fairly
- Do not use ThoughtStream Lab for anything unlawful, or to harm or harass anyone.
- Do not try to break, overload or probe the app's limits, access controls, or another account's data.
- Do not scrape the app, resell it, or offer it as your own service.
- Do not run automated bulk use through an account, beyond the assistants you have deliberately connected and the allowances your plan allows.
- We may slow down, suspend or end an account that abuses the service, endangers other accounts, or breaks these terms. Where it is reasonable to do so, we will tell you why first.
Availability and changes
We work to keep ThoughtStream Lab available, but it is not promised uninterrupted: it may be briefly unavailable for maintenance or because something has broken, and we may add, change or retire features.
If we make a change that materially reduces what a paid plan includes, we will tell account holders by email before it takes effect, so you can decide what to do. A material change is also a fair reason to cancel, and the refunds above apply.
Ending it
You can stop using ThoughtStream Lab at any time, and delete your account and its contents in Settings. We may end or suspend an account that breaks these terms, or where we have to for legal or security reasons. When an account ends, the permission you gave us to hold and process its contents ends with it.
Limits of our responsibility
ThoughtStream Lab is provided as it is. We do not promise that the assistant's output is accurate or fit for a particular purpose, and you use it at your own judgement. To the extent the law allows, we are not liable for indirect or consequential losses, or for lost profits, data or opportunity.
Where we are liable, our total liability to you is limited to the amount you paid for ThoughtStream Lab in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law, and nothing here affects the rights you have as a consumer where you live, including any right to a refund.
Which law applies
These terms are governed by the laws of the State of California, and SK America LLC is at 255 N D St, Suite 200XIX, San Bernardino, CA 92401, in San Bernardino County, California. That does not take anything away from you: where you live, the consumer rights you have cannot be signed away, and they still apply to you whatever these terms say.
Talk to us first
If something has gone wrong, please tell us before taking it further. Most problems are settled quickly, and any refund the law calls for is one of them. Write from the email address on your account using the contact page, and how your data is handled is described in the privacy policy.
SK America LLC is the company you are dealing with, and Stephen J. Kinzey, Ph.D. is the person responsible for it. Anything you want to put in writing to the company itself, including a formal notice or a refund request the law entitles you to, can be addressed to him through that same contact page, by post to SK America LLC, 255 N D St, Suite 200XIX, San Bernardino, CA 92401, or by telephone on 909-255-6898. We will confirm we have received it.
